| Description | Provincial Offences Act (POA) charges and Administrative Penalty System (APS) penalty notices are administered at the Ontario Court of Justice, Court Administration at 950 Burnhamthorpe Road. The POA (Provincial Offences Act) governs how charges are processed and prosecuted. It applies to all provincial statutes, as well as, municipal by-laws and some minor federal contraventions. Most of the POA offences filed in our court fall under the Highway Traffic Act, the Compulsory Automobile Insurance Act, the Liquor Licence Act or the Trespass to Property Act. Most of those offences are minor and paid out-of-court. POA charges are disputed at this court. The Ontario Municipal Act, 2001 allows municipalities to use an Administrative Penalties System (APS) for by-law violations relating to parking and licensing. Penalty Notices are issued for less serious contraventions and most administrative penalties will be paid without dispute. If a person wishes to have a penalty notice reviewed by a Screening Officer this will take place at this court location as well reviews conducted by Hearing Officers. |
